As article 4.12 Texas Code of Criminal Procedure: Art. 4.12. [60a] Misdemeanor Cases; Precinct in Which Defendant to be Tried in Justice Court (a) Except as otherwise provided by this article, a misdemeanor case to be tried in justice court shall be tried: (1) in the precinct in which the offense was committed; (2) in the precinct in which the defendant or any of the defendants reside; or (3) with the written consent of the state and each defendant or the defendant's attorney, in any other precinct within the county. As the courts stands civilly as well as criminally liable for acting against me in violation of the due course of the laws in a matter where the court is clearly without jurisdiction, in order to abate further legal process, please provide findings of fact and conclusions at law in support of your decision to deny my motion in abatement. Contrary to the prosecutors complaint about timelessness, when the first act before a given court is a motion in abatement, it is considered timely. “Except as otherwise provided,” by reading the statute and ascribing the “common meanings of the terms,” that reference can only be to paragraph (a) (3). But as I mentioned in court, there was no motion to change venue and I certainly signed nothing to that effect, it would appear, you were clearly without venue. At court you asked me to provide support for my claim your court was without jurisdiction, when in fact, the onus is on the court to show that it has jurisdiction, not on me to show it doesn’t. FACED WITH ACCUSER The United States Constitution provides that no person may be deprived of life, liberty, or property without due process of law (US Const Fifth Amendment: US Const Fourteenth Amendment Ї1. Baker v McCollant (1979) 443 US 137); the analogous provision in the Texas Constitution declares that no citizen of this state may be deprived of life, liberty, property, privileges, or immunities, or be in any manner disfranchised, except by the due course of the law of the land. (Texas Const Art I Ї19). The latter provision is also contained in the Code of Criminal Procedure, Article 104. Due process of law is the application of the law as it exists, in the fair and regular course of administrative procedure (Frasher v State (1877) 3 App 263). Due process has been said to require that an accused be accorded that fundamental fairness that is necessary to due administration of justice (Webb v State (1955) 278 SW2d 158). And due process precludes subjecting an individual to the arbitrary exercise of the powers of government, unrestrained by established principles of private rights (Caldwell v Texas (1891) 137 US 692). Due process rights guaranteed by the United States and Texas Constitutions to persons accused of crime must be strictly observed. The legislature, executive, or courts may not disregard them. (Valle v State (1882) 12 App 57). They are not the subjects of judicial discretion (State ex rel. Moreau v Gond (1925) 271 SW 379). However, the legislature may prescribe the manner of asserting and enforcing the rights. Huntsman v State (1882) 12 App 619 A statute must accord due process of law. Nothing is paramount to this requirement. The equal protection clause of the Fourteenth Amendment (US Const Fourteenth Amendment) permits the States a wide scope of discretion in enacting laws, including criminal laws, that affect some groups of citizens differently than others (McGowan v Maryland (1961 366 US 420). But under the Fourteenth Amendment no state can deprive particular persons or classes of persons of equal impartial justice under the law (Caldwell v Texas (1891) 137 US 692) Statutes defining crimes and punishment must operate in a uniform manner on individuals of the class embraced in the law (Jannin v State (1899) 51 SW 1126), and must require the same treatment of all who are in like conditions and circumstances (Ratcliff v State (1926) 289 SW 1072, 1094-1099). A law that makes different punishments follow the same criminal acts in different political subdivisions of the state fails to accord equal protection of h laws (Ex parte Sizemore (1978) 434 US 357). To stand and be faced by my accuser is so basic a right in this country; it is amazing that any court would consider it so inconsequential as to ignore it. Therefore, I move this court to show its authority to force me to stand before the court while refusing to grant my right to be faced by my accuser. I realize due course of lay may at times be administratively inconvenient or adjudicatively inexpedient, but the Supreme Court has held that such can never be cause to deny an citizen in his rights.
